By checking the box at checkout — "I own or am licensed to use any logo I upload, and I agree to the Terms & Privacy Policy" — or by using the Service, you ("you," the "Customer") agree to these Terms and to the Privacy Policy, which is incorporated by reference. You represent that you are at least 18 years old and able to form a binding contract; if you are agreeing on behalf of a company, you represent that you are authorized to bind it. We record the version of these Terms and the time of your acceptance with your order.
Huevault generates decorative, brand-color background "plates" and 4K render bases using AI image models. If you upload a logo or mark, we composite ("elevate") your uploaded file, as provided, onto those plates and deliver the results as a downloadable ZIP (4K masters plus platform crops). The plates are decorative backgrounds and render bases — they are not finished advertisements and do not depict your actual product.
"Customer Content" means any logo, mark, brand name, tagline, text, color, or other material you submit.
You represent and warrant that:
We do not perform trademark clearance, ownership verification, or legal review of what you upload, and we rely on the warranties above.
You will defend, indemnify, and hold harmless JK.Creative and its owners, members, and contractors from and against any third-party claim, demand, loss, liability, damage, cost, or expense (including reasonable attorneys' fees) arising out of or related to (a) your Customer Content, (b) your breach of Section 3, or (c) your use of the deliverables. JK.Creative may participate in the defense with counsel of its choice, and you will not settle any claim in a way that imposes obligations on JK.Creative without our consent. Your obligations in this Section are not subject to the liability cap in Section 11 and survive termination (see Section 15).
Subject to your payment and these Terms, we grant you a worldwide, perpetual, non-exclusive, royalty-free license to use, modify, reproduce, and distribute the delivered image files for your own personal and commercial purposes (marketing, social, web, print, product, and paid ads), including compositing your own product, logo, and copy onto them. The detailed license, and the important limits on it, are in the LICENSE.txt included with every order and are incorporated here by reference. You may not resell or redistribute the files themselves as a stock/template pack or represent them as your own for licensing to others.
The background plates are AI-generated. Based on current U.S. Copyright Office guidance, purely AI-generated images generally receive no copyright protection; accordingly we do not claim copyright in the plate imagery, we make no representation that any party holds exclusive rights in it, and we do not promise that identical or similar plates will not be produced for others or exist elsewhere. (This reflects guidance that continues to evolve; it is not a guarantee of any particular legal outcome.) This "no exclusivity / no copyright" statement applies to the plate imagery only — it does not affect whatever rights you hold in your own uploaded mark, which remains yours.
We retain your brief and uploaded Customer Content only as long as needed to produce, deliver, and support your order, and then per the schedule in our Privacy Policy. You may request deletion of your uploaded Customer Content at any time by emailing support-huevault@jkcreative.store; we will delete it within a reasonable period except where we must retain records for legal, tax, or fraud-prevention purposes. Download links expire (currently 60 days).
Don't use Huevault to infringe others' rights, to create unlawful, deceptive, hateful, or harmful material, or to probe, overload, or attack the Service. We may refuse or cancel any order at our discretion and refund it.
THE SERVICE AND ALL DELIVERABLES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the deliverables are suitable for any particular use, that plates are exclusive, or that the Service will be uninterrupted or error-free.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JK.CREATIVE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE ORDER GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of- laws rules. The state and federal courts located in Spokane County, Washington will have exclusive jurisdiction, and you consent to venue there.
We may update these Terms; the "Last updated" date will change and the current version will be posted at the Service. Continued use after an update means you accept the revised Terms.
If you believe content submitted to or delivered by the Service infringes your copyright or trademark, email support-huevault@jkcreative.store with: (a) identification of the work/mark and the allegedly infringing material, (b) your contact information, (c) a statement of good-faith belief that the use is unauthorized, and (d) a statement, under penalty of perjury, that the information is accurate and you are the rights holder or authorized to act. We will review and, where appropriate, remove or disable the material, and we may terminate the accounts or orders of repeat infringers.
